An area man has been convicted of committing acts of sexual and physical abuse against his daughter over the course of more than six years, Monmouth County Prosecutor Raymond S. Santiago announced on Wednesday.
Following a trial before Monmouth County Superior Court Judge Christie Bevacqua, 51-year-old Andrey V. Penkin, of Marlboro, was found guilty of the following charges stemming from the abuse: two counts of first-degree aggravated sexual assault, second-degree aggravated sexual assault, and two counts of second-degree endangering the welfare of a child. The charge of aggravated sexual assault involves penetration.
Upon sentencing, the date of which has not yet been determined, Penkin will face a minimum of 25 years in state prison with no eligibility for parole, in accordance with the provisions of New Jersey’s Jessica Lunsford Act.
The case background …
An investigation by members of the MCPO Special Victims Bureau and the Marlboro Police Department found that the abuse of Penkin’s daughter began in 2016, when the family lived in Sayreville (Middlesex County).
Numerous incidents of sexual abuse followed, both in Sayreville and at their next two residences in East Brunswick and Marlboro.
In early 2023, after discovering his daughter to be in possession of a friend’s pack of cigarettes, Penkin physically assaulted her, causing a severe concussion and related facial injuries.
Penkin was arrested in April of 2023. At trial, the state presented medical records, witness testimony, and physical evidence, including the victim’s diary, to prove its case.
The jury deliberated for 80 minutes before returning guilty verdicts.
This case was prosecuted by Monmouth County Assistant Prosecutors Sarah Mielke and Liz Torres. Penkin was represented by Michael Gilberti, Esq., with an office in Tinton Falls, and Samuil Buschkin, Esq., with an office in Ridgewood.
