Prosecutor: 18- and 21-Year Old Get Prison Time for 2023 Triple Shooting that Left One Dead

Two young men, 18 and 21, have been sentenced to prison terms for their roles in a July 2023 shooting that left one man dead and two others injured, Monmouth County Prosecutor Raymond S. Santiago announced on Friday.

Ziamere Ivery, 18, of Neptune Township, and Michael Sally, 21, of Long Branch, having both pleaded guilty on Friday, May 9, were sentenced on Oct. 17 to 18 and seven years in state prison, respectively, in accordance with terms set forth by Monmouth County Superior Court Judge Jill G. O’Malley, J.S.C..

Ivery, who pleaded guilty to one count of first-degree aggravated manslaughter, must serve 85 percent of his term before the possibility of parole, under the provisions of New Jersey’s No Early Release Act. Sally, admitted to one count of second-degree unlawful possession of a weapon (firearm), and now must serve 42 months prior to parole eligibility in accordance with the New Jersey Graves Act.

The case background …

Shortly after 10:30 p.m. on Monday, July 3, 2023, Asbury Park police were dispatched to the Asbury Park Gardens apartment complex on Atlantic Avenue on a report of a shooting. Upon arrival at the scene, officers found the three victims, all adult males who had sustained injuries.

The victims were rushed to Jersey Shore University Medical Center, where two were treated for their injuries and released. The third victim, Lativity Lyons, 21, of Asbury Park, succumbed to his injuries and was pronounced dead at 10:50 p.m. A fourth victim, the intended target of the shooting, only sustained a minor injury but did not seek medical treatment.

The investigation into Lyons’ death, led by members of the Monmouth County Prosecutor’s Office Major Crimes Bureau and the Asbury Park Police Department, resulted in the charges against Ivery and Sally.

Ivery, originally charged as a juvenile defendant, was previously waived up to adult court.
