Prosecutor: Monmouth County Man Convicted of 2016 Burglary of 90-Year-Olds

A Monmouth County man has been convicted of a December 2016 residential nighttime burglary of two 90-year-old brothers in Bradley Beach, Monmouth County Prosecutor Christopher J. Gramiccioni announced.

Andre Figueroa, 37, was found guilty Friday afternoon of: third-degree burglary, third-degree theft, and fourth-degree resisting arrest. The verdict was delivered after a 3-day trial in the courtroom of Monmouth County Superior Court Judge Joseph W. Oxley.

Evidence presented at the trial by Assistant Monmouth County Prosecutor Emily Cartmell revealed that on Dec. 5, 2016, at approximately 11:30 p.m., Figueroa was spotted by Bradley Beach Police Officer Andrew Redmond walking out from behind a residence on Bradley Boulevard.

Figueroa was wearing a red headlamp on his head and carrying a black bag. The officer followed Figueroa and attempted to stop him, however Figueroa ignored his commands and fled. After a brief chase, Officer Redmond captured Figueroa in the parking lot of Vic’s restaurant on Main Street.

Officer Redmond returned to the residence Figueroa was seen leaving and found an open window with a fresh footprint. Police entered the home and found two elderly brothers, both in their 90s, unhurt and asleep inside.

One of the residents reported that he was missing clothing, his wallet, credit cards, social security card, driver’s license and approximately $3,000 cash.

Police then retraced Figueroa’s route from the home until where he was captured by police and discovered the stolen clothing on the sidewalk containing the victim’s wallet, personal documents, credit cards and cash which had been discarded by the defendant during his attempt to flee.

Figueroa is scheduled to be sentenced by Judge Oxley on May 18. Based on his numerous prior convictions for burglary and other offenses, he faces a maximum sentence of 10 years in New Jersey State Prison with a five year period of parole ineligibility.

The case was prosecuted by Monmouth County Assistant Prosecutor Emily Cartmell.
